Equity and Property
Our expertise in Equity extends to disputes concerning wills, trusts (constructive, charitable and otherwise) and construction suits. Banco barristers also appear in substantial disputes raising equitable issues concerning leases, mortgages, partnership disputes and general contractual disputes.
Members of Banco Chambers are experienced in applying for and resisting all forms of urgent relief, such as injunctions and freezing orders, as well as cases between employers and former employees in relation to restraints of trade, non-competition provisions and misuse of confidential information.
This area of law includes large and complex family law and trust disputes involving the identification and division of property. Some of our senior members appear in significant contested property applications in the Family Court of Australia, at both first instance and on appeal.
